1. Acceptance of Terms

By accessing or using StudentClaw ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

StudentClaw is operated by Embite, a company registered in The Netherlands. These terms constitute a legally binding agreement between you and Embite.

2. Description of Service

StudentClaw is an AI-powered study assistant that operates through messaging platforms (WhatsApp and Telegram). The Service provides:

  • Proactive study reminders and deadline notifications
  • On-demand study help and explanations
  • Schedule and deadline management
  • Motivational support and check-ins

The Service uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may occasionally contain errors. You should verify important information independently.

3. Eligibility

You must be at least 16 years old to use StudentClaw. By using the Service, you represent that you meet this age requirement. If you are under 18, you may need parental consent depending on your jurisdiction.

4. Account Registration

To use StudentClaw, you must create an account and connect your messaging platform. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

5. Subscription and Payments

5.1 Free Trial

New users may be eligible for a free trial period. Trial terms will be communicated at sign-up. At the end of the trial, you will need to subscribe to continue using the Service.

5.2 Subscription Plans

Paid subscriptions are billed on a recurring basis (monthly or as specified). Prices are subject to change with notice. Early access users may receive promotional pricing.

5.3 Token System

Usage may be measured in tokens or messages. Your plan includes a certain allocation. Additional tokens can be purchased if needed. Unused tokens may expire based on your plan terms.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

6. Acceptable Use

You agree NOT to use StudentClaw to:

  • Violate any laws or regulations
  • Submit content that infringes on intellectual property rights
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems
  • Use the Service for academic dishonesty (e.g., having AI write assignments you claim as your own work)
  • Share your account with others
  • Reverse engineer or attempt to extract our AI models
  • Use automated systems to access the Service

We reserve the right to suspend or terminate accounts that violate these terms.

7. Academic Integrity

StudentClaw is designed to help you learn and stay organized, not to do your work for you. You are responsible for ensuring your use of the Service complies with your educational institution's academic integrity policies.

We encourage using StudentClaw for:

  • Understanding concepts and getting explanations
  • Brainstorming and outlining ideas
  • Reviewing and getting feedback on drafts
  • Managing your schedule and deadlines

8. Intellectual Property

The StudentClaw service, including its design, features, and underlying technology, is owned by Embite and protected by intellectual property laws.

You retain ownership of the content you upload (documents, schedules, etc.). By uploading content, you grant us a license to process it for the purpose of providing the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • AI-generated responses will be accurate or complete
  • The Service will meet your specific requirements
  • Use of the Service will improve your academic performance

StudentClaw is a study aid, not a substitute for professional academic support, tutoring, or mental health services.

10. Limitation of Liability

To the maximum extent permitted by law, Embite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Academic penalties resulting from use of the Service
  • Loss of data or content
  • Service interruptions

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Third-Party Services

StudentClaw operates through WhatsApp and Telegram, which are third-party services with their own terms and privacy policies. Your use of these platforms is governed by their respective terms.

We use third-party AI providers (such as Anthropic) to power our assistant. While we have data processing agreements with these providers, we encourage you to review our Privacy Policy for details.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of The Netherlands. Any disputes shall be resolved in the courts of The Netherlands, unless EU consumer protection laws grant you the right to bring proceedings in your country of residence.
